Preamble:

These Terms and Conditions (“Terms”) govern the relationship between Yoga&Sail IKE (“we,” “our,” or “us”) and clients (“you” or “guest(s)”) booking our services. By entering into agreements with Yoga&Sail IKE, you confirm that you have read, understood, and agreed to these Terms in full.

1. Terminology

1.1 Yoga&Sail IKE: A Greek limited company providing consulting, local knowledge , crew services and travel agency services for yachting experiences.

1.2 Yacht Owner/Management Company: A third party responsible for yacht charter agreements, yacht maintenance, and technical matters.

1.3 Lead Charterer: The individual to whom the confirmation invoice is addressed, representing the Guests and responsible for all communication, payments, and compliance with these Terms.

1.4 Yoga Instructor: An independent individual or entity providing yoga instruction during the trip, not employed or verified by Yoga&Sail IKE. The Yoga Instructor can be the Lead Charterer.

1.5 Guests: Individuals or groups booking services provided by Yoga&Sail IKE or third parties.

2. Scope of Services

Yoga&Sail IKE offers the following services:

2.1 Consulting, Education, and Local Knowledge: Guidance on itinerary planning, destination expertise, and pre-trip preparation.

2.2 Crew Services: Providing professional skippers, chefs, and hostesses, along with additional services like restaurant bookings, grocery shopping, and local guidance.

2.3 Travel Agency Services: Acting as a broker to connect clients with yacht owners or management companies, initiating yacht charter agreements, and optionally handling the payments between parties. Yoga&Sail IKE assumes no responsibility for the quality, safety, or performance of third-party services.

2.4 Charter Contract Authorization
As part of our brokerage services, Yoga&Sail IKE may act as your authorized representative to facilitate the yacht charter process. Upon your explicit written request, we can be mandated to sign the charter contract on your behalf with the third-party yacht owner or management agency. Please note that the yacht charter agreement and its execution remain governed exclusively by the terms and conditions of the third-party provider. While we assist in coordinating these arrangements, all rights, obligations, and liabilities arising from the charter contract are solely between you and the third party.

Important:

• Yoga&Sail IKE is not a tour operator and does not provide comprehensive travel packages.

• Each service is contracted and invoiced separately.

• To the fullest extent permitted by law, Yoga&Sail IKE assumes no liability for services rendered by third parties.

3. Travel Arrangements and Insurance

3.1 Guests are responsible for arranging travel to the designated marina or port of departure. Travel planning and costs are not managed by Yoga&Sail IKE. 

3.2 Guests are required to purchase adequate travel insurance, covering medical emergencies, cancellations, and other disruptions. Yoga&Sail IKE will not be held liable for such occurrences. Yoga&Sail IKE will not be held liable for uninsured risks or failures to obtain adequate coverage.

4. Booking and Payment Policies

4.1 Down Payment: A 50% down payment is required to confirm the booking. The agreement becomes valid only upon receipt of this payment.

4.2 Balance Payment: The remaining balance must be paid as stipulated in the booking confirmation. Failure to complete the payment may result in cancellation of the booking.

4.3 Cancellation Policy:

• Cancellations made more than 45 days before departure: 30% of the down payment is non-refundable.

• Cancellations made less than 45 days before departure: 100% of the total cost is non-refundable.

4.4 Charter Payments: Yoga&Sail IKE can manage payments for the yacht charter on behalf of the lead charterer and the yacht owner/management company. Disputes regarding payments can be voluntarily communicated through Yoga&Sail IKE, but in case of dissatisfaction of either of the parties, disputes must be resolved directly between the lead charterer and the yacht owner/management company.

5. Yacht Charter and Liabilities

5.1 Third-Party Agreement: The yacht charter agreement is between the guest(s), represented by the Lead Charterer, and the yacht owner/management company. Yoga&Sail IKE is not a party to this agreement and assumes no liability for the yacht’s condition, performance, or functionality.

5.2 Equal or Higher Replacement of Yacht: If the booked yacht becomes unavailable, the yacht owner/management company will provide a replacement yacht of comparable quality, as determined by the yacht owner/management company. Yoga&Sail IKE assumes no liability for such changes. The replacement yacht may vary slightly in layout, size, or amenities but will not diminish the quality of the experience.

5.3 Defects and Compensation:

• Claims related to yacht defects are limited to the duration of the disruption. For example, a 24-hour engine failure during a 7-day charter may allow for compensation of 1/7th of the yacht charter cost.

• Crew services remain payable in full as their duties continue during disruptions.

5.4 Security Deposit: The yacht owner/management company requires a refundable security deposit, payable by the lead charterer in cash or credit card on the day of departure. This deposit is separate from Yoga&Sail IKE services. Disputes regarding security deposits can be voluntarily communicated through Yoga&Sail IKE, but in case of dissatisfaction of either of the parties, disputes must be resolved directly between the lead charterer and the yacht owner/management company.

6. Check-In and Check-Out

6.1 Standard check-in begins usually on a Saturday at 17:00.

6.2 Check-out must be completed by Saturday before 9:00, unless otherwise agreed upon in the charter agreement with the yacht owner/management company.

6.3 The lead charterer is responsible for ensuring compliance with these timings.

7. Crew Duties

7.1 Skipper: Responsible for yacht navigation, safety, itinerary adjustments due to weather, and technical handover on behalf of the lead charterer.

7.2 Chef: Plans the Menus, prepares meals, buys / manages provisions, and ensures high hygiene standards in the galley. If there is no first/second mate or a host/ess on board, the chef also takes the duties of the mate.

7.3 Host/ess: Provides housekeeping for shared spaces, assists the chef, and supports guest comfort and activities. The host/ess takes the duties of the mate on board. If there is no chef on board, the hostess can have duties described as in 7.2.

7.4 Guest Responsibilities:

• Guests must maintain the reasonable tidiness of their cabins and en-suite bathrooms.

• The crew does not provide personal cleaning services for guests’ quarters or lavatories.

8. Yoga Instruction and Liability

8.1 Yoga&Sail IKE does not verify the qualifications of yoga instructors. Yoga sessions are conducted independently, and liabilities arising from yoga practice (e.g., injuries) are the sole responsibility of the instructor or yoga school.

8.2 Yoga instructors or schools must provide insurance covering injuries or adverse outcomes caused by yoga practice.

8.3 Guests participate in yoga sessions voluntarily and are advised to communicate any medical conditions directly to the instructor.

9. Force Majeure

Yoga&Sail IKE is not liable for failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, extreme weather, wars, pandemics, strikes, or government actions. In such cases, Yoga&Sail IKE will assist in mitigating disruptions but will not offer refunds or compensation. Yoga&Sail IKE will assist with rebooking or rescheduling services, and will make efforts to find alternatives on shore if affected by force majeure but cannot guarantee success.

  • No refunds will be issued for disruptions caused by force majeure.
  • Yoga&Sail IKE will assist in mitigating disruptions and may offer rebooking, rescheduling options, and will make efforts to find alternatives on shore, but cannot guarantee success.

10. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court, the remaining provisions shall remain in full force and effect. The invalid provision will be replaced by a valid and enforceable provision that most closely reflects the intent of the original.

11. Jurisdiction and Governing Law

11.1 These terms and conditions are governed by Greek law.

11.2 Any disputes arising from this agreement must be resolved in Greek courts.
